1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you, whether personally or on behalf of an entity ("you", "your", or "Client"), and JobsEden Technologies Limited (RC: 9279655) ("JobsEden", "we", "us", or "our"), concerning your access to and use of the jobseden.com website and our job posting services.
By accessing our website or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you must discontinue use immediately.
2. Service Description
JobsEden provides a performance-based job posting and distribution service. Our service includes:
- Receiving and formatting your job postings
- Distributing job listings to multiple third-party platforms (including but not limited to Jobberman, Indeed, LinkedIn, and other job boards)
- Tracking and counting applications received through our designated links
- Forwarding qualified applications to you
- Generating invoices based on application counts
We do not guarantee any specific number of applications, views, or hiring outcomes. Results vary based on job type, location, salary, market conditions, and other factors outside our control.
3. Pricing and Payment Terms
3.1 Pricing
You agree to pay the per-application fee as quoted at the time of service (starting from ₦1,000) for each qualified application received through our tracking links. This price may be updated with 30 days' notice.
3.2 Definition of Qualified Application
A "qualified application" is defined as a candidate submission that contains, at minimum:
- The candidate's name
- At least one valid contact method (email or phone number)
- Submission via our designated tracking URLs or forms
Duplicate applications, spam, bot submissions, and incomplete submissions are excluded from billing at our discretion.
3.3 Invoicing
Invoices are generated monthly based on the total count of qualified applications received during the billing period. Invoices will be sent via email and include a detailed breakdown of applications per job posting.
3.4 Payment Terms
- Payment is due within 7 days of invoice receipt.
- Accepted payment methods include bank transfer and other methods specified on the invoice.
- All prices are in Nigerian Naira (₦) and exclusive of applicable taxes.
- Late payments may incur a fee of 5% per month on outstanding balances.
3.5 Disputes
If you dispute any application charges, you must notify us in writing within 7 days of receiving the invoice. We will review disputes in good faith and provide evidence of tracked applications upon request.
4. User Responsibilities
By using our services, you represent and warrant that:
- All information you provide is true, accurate, current, and complete.
- You have the legal authority to post jobs on behalf of your organization.
- Your job postings comply with all applicable Nigerian labor laws, including the Labour Act.
- Your job postings do not discriminate based on ethnicity, religion, gender, disability, or other protected characteristics.
- You will not post fraudulent, misleading, or deceptive job listings.
- You will respond to and process applications in a professional and timely manner.
- You will not use our service for any illegal or unauthorized purpose.
5. Prohibited Uses
You may not use our services to:
- Post jobs for illegal activities or positions that violate Nigerian law
- Collect candidate information for purposes other than legitimate hiring
- Post jobs requiring upfront fees or payments from candidates
- Advertise multi-level marketing schemes or commission-only positions without disclosure
- Harvest candidate data for marketing or resale purposes
- Circumvent or manipulate our application tracking systems
- Submit false or misleading job information
6. Intellectual Property
The JobsEden name, logo, website design, and all related intellectual property are owned by JobsEden Technologies Limited. You may not use our trademarks without prior written consent.
You retain ownership of the content you provide (job descriptions, company information, etc.). By submitting content to us, you grant JobsEden a non-exclusive, royalty-free license to use, reproduce, modify, and distribute that content for the purpose of providing our services.
7. Third-Party Platforms
Our service involves distributing your job postings to third-party job boards and platforms. We are not responsible for the terms of service, privacy policies, or practices of third-party platforms, nor for content modifications, outages, or rejection of your job postings by these platforms.
8. Service Availability
We strive to provide reliable service but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any part of our service with reasonable notice.
9. Limitation of Liability
To the fullest extent permitted by Nigerian law:
- JobsEden shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
- Our total liability for any claim shall not exceed the total fees paid by you in the 3 months preceding the claim.
- We are not liable for any loss of profits, revenue, data, business opportunities, or anticipated savings.
- We are not responsible for hiring decisions, candidate suitability, or employment outcomes.
10. Indemnification
You agree to indemnify, defend, and hold harmless JobsEden Technologies Limited, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses arising from your use of our services, your violation of these Terms, or your job postings.
11. Termination
Either party may terminate this agreement at any time by providing written notice. Upon termination, we will remove your active job postings, but you remain liable for all fees incurred up to the termination date.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Nigeria.
13. Dispute Resolution
Before initiating any legal proceedings, you agree to attempt to resolve disputes informally by contacting us at [email protected]. We will work in good faith to resolve the matter within 30 days. If informal resolution fails, either party may pursue mediation or arbitration under the Arbitration and Mediation Act of Nigeria.
14. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through our website at least 14 days before taking effect. Continued use of our services after changes take effect constitutes acceptance of the revised Terms.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and JobsEden regarding our services and supersede all prior agreements and understandings.
